Terms of Use and End User License Agreement
IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY
This Agreement outlines the terms and conditions governing the use of the software and subscription services provided by Real IQ LLC ("Real IQ"). By accessing or subscribing to these services, you, the end-user ("Client"), agree to comply with the terms outlined here, as well as any prior agreements made with Real IQ, such as a Student Purchase Agreement ("Agreement").
Access to Real IQ’s services is contingent upon your agreement to abide by these Terms of Use without any modifications. By using Real IQ’s services, you explicitly acknowledge and agree to be bound by these terms. Real IQ reserves the right to modify or update the Terms of Use at its discretion, with such changes taking effect upon posting on Real IQ’s website.
Real IQ will process billing on a recurring monthly subscription basis as described during the sign-up process. This includes charges for upgrades, premium features, or additional services selected by the Client. Billing will continue until the Client cancels their subscription. Cancellation can be initiated at any time by contacting Real IQ Customer Support at (561) 770-8474.
In the event that the Client's primary payment method is declined for any reason, the Client authorizes Real IQ to charge any alternative payment methods associated with their account to cover outstanding balances.
As a Client of Real IQ, you are granted a limited, non-exclusive, and non-transferable license to access and use the services, data, and information provided by Real IQ during your active subscription period. This license is subject to the License Restrictions outlined below.
License Restrictions
The Client agrees that all data, information, and services provided by Real IQ are strictly for personal use and may not be accessed or used by any third party—such as agents, employees, or contractors—without the appropriate subscription level. Real IQ reserves the right to monitor usage, including search volumes, to detect and prevent misuse such as excessive data usage, “data mining,” or abnormal activity. Any violations, as determined by Real IQ at its sole discretion, will result in the immediate termination of the Client's account.
The Client further agrees not to:
Use the data or services for telemarketing, promotional, marketing, or any commercial purposes without proper authorization.
Reproduce, share, distribute, resell, or reuse data with third parties for personal or commercial endeavors.
Engage in online scraping, data extraction, or unauthorized internet-based activities.
Combine or integrate Real IQ data with other products, services, systems, or applications, including valuation models or financial tools.
Use the data for appraisals, credit evaluation, insurance analysis, or related financial services.
Use the services for debt collection, legal services, or activities like bankruptcy or foreclosure assistance.
Permitted Use Policy
By using our services, you agree to follow these guidelines:
Lawful Use Only: Ensure your activities are legal and free from fraudulent or deceptive practices, including refraining from transmitting illegal content.
Respectful Behavior: Avoid actions that cause harm, disturbance, or annoyance to others.
Personal Use: Use our services and content for personal, non-commercial purposes unless explicitly authorized.
Privacy Protection: Respect the privacy and publicity rights of all individuals.
Content Use Limits: Do not reproduce, share, or compile content from our platform beyond personal use.
Honest Information: Provide accurate and truthful details when communicating or interacting through the platform.
Service Integrity: Avoid disrupting, overloading, or impairing the functionality of our services or connected networks.
Authorized Access Only: Do not attempt to access unauthorized systems, accounts, or networks.
Prohibited Automation: Refrain from using automated tools like bots or crawlers without prior approval.
Prompt Reporting: Notify us of any bugs, errors, or breaches of intellectual property you discover.
Account Responsibility: Do not impersonate others, misuse accounts, or create multiple accounts without justification.
Compliance with Laws: Follow all applicable laws, including those related to electronic advertising and spam.
File Upload Restrictions: Upload files only within size limits and requirements as determined by us.
Privacy and Security
By accepting this Acceptable Use Policy, you also agree to our Privacy Policy, which outlines how we collect, use, and protect personal data.
When subscribing to a paid plan, you confirm that:
You will disclose how personal information obtained through our services is collected and used, ensuring compliance with all applicable privacy, data protection, and email marketing laws.
You will safeguard your user credentials and notify us immediately of any unauthorized access or misuse.
You will promptly inform us of any privacy-related complaints, requests, or inquiries regarding data obtained from our platform.
Proprietary Rights and Subscription Terms
The Client acknowledges and agrees that all data, information, services, and the Real IQ name are the exclusive property of Real IQ LLC, its affiliates, and suppliers. These are protected under copyright, trademark, trade secret, and other intellectual property laws. The license granted to the Client permits the use of this data and services only within the limitations outlined in these Terms of Use and for the duration of the Client’s valid subscription.
Should Real IQ LLC determine, at its sole discretion, that the Client has violated any terms or restrictions, Real IQ LLC may terminate the Client’s access immediately. In such cases, a pro-rata refund may be issued at Real IQ’s discretion, depending on the severity of the violation and the time and data accessed during the subscription period.
Subscription and Termination
The Client’s subscription operates on a month-to-month basis, automatically renewing unless canceled by either party. The Client may terminate their subscription at any time by contacting Customer Support at (877) 204-9040. However, all fees due up to the end of the current billing cycle remain payable. Real IQ LLC reserves the right to terminate the subscription and access to its platform at any time, for any reason, or no reason, with no further obligation to the Client beyond a pro-rata refund for the unused portion of the current subscription period.
Survival of Terms
Provisions regarding Proprietary Rights, License Restrictions, and other clauses intended to survive termination will remain in effect after the termination of this agreement and/or the Client’s subscription.
Client Services and Third-Party Providers
The Client affirms that all information provided to Real IQ LLC is accurate and complete and agrees to promptly update Real IQ LLC with any changes. If Real IQ LLC determines, at its sole discretion, that inaccurate or misleading information has been provided, access to services may be suspended or terminated.
Real IQ LLC may occasionally offer promotional opportunities to eligible Clients, though not all Clients may qualify for every promotion.
Real IQ LLC may feature third-party services (e.g., skip tracing, email marketing, or direct mail) for Client convenience. However, Real IQ LLC does not endorse, guarantee, or assume liability for these services. Clients are encouraged to independently evaluate third-party providers before engaging their services. Third-party offerings are provided "as-is," and Real IQ LLC is not responsible for their actions, omissions, or performance. Links to third-party websites are provided for convenience and do not imply endorsement.
Content and Service Modifications
Real IQ LLC does not control content provided by third parties but reserves the right to review and remove any content that violates laws or company policies. For handling personal information, Clients should refer to Real IQ LLC’s Privacy Policy.
Real IQ LLC reserves the right to modify, update, or discontinue any service or feature without notice. Clients acknowledge that Real IQ LLC will not be liable for such changes.
Payment Terms
Clients agree to pay a non-refundable monthly subscription fee, charged in advance each month. Subscription fees may be modified with a minimum of 30 days’ notice sent to the Client’s registered email address. Charges will continue to accrue until the subscription is canceled, regardless of service usage.
Payment and Terms of Use Timely Payment
Clients are required to make all payments on time using valid and active payment methods. Failure to pay the full amount or submit timely payments may result in suspension or termination of access to Real IQ services. If a primary payment method expires or is declined, the Client authorizes Real IQ LLC to charge any alternative payment methods on file. Real IQ LLC may extend the expiration date of a payment method at its discretion to maintain uninterrupted service.
Accepted Payment Methods
Clients must provide accurate billing information, including a complete billing address and phone number. Accepted payment methods include major credit cards (Visa, MasterCard, Discover, American Express), bank drafts, personal checks, money orders, cashier’s checks, and company checks sent by mail. Real IQ LLC may charge a handling fee of $20.00 or the maximum amount allowed by law for any returned checks.
Resolving Account Issues
For account-related questions or billing discrepancies, Clients can contact Real IQ Customer Service via email at [email protected] or phone at (561) 770-8474. If an issue is not resolved within 15 business days or within 90 days of identifying the discrepancy, Clients must submit a written complaint to Real IQ LLC at:

Failure to submit a written complaint within this timeframe will result in the waiver of any claims regarding the dispute.
Disclaimers and Limitations
Real IQ LLC strives to provide accurate and reliable services; however, all services, data, and products are provided “as-is.” Real IQ LLC disclaims all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Clients acknowledge that the use of Real IQ’s services is at their own risk. Real IQ LLC is not liable for any direct, indirect, punitive, incidental, or consequential damages arising from the use of its services, whether due to negligence, breach of contract, or other legal causes.
Indemnification
Clients agree to indemnify and defend Real IQ LLC, its employees, agents, and service providers against any claims, liabilities, expenses (including attorney fees), or damages resulting from the Client’s use of Real IQ services, including breaches of these Terms of Use.
Jurisdiction and Legal Terms
Choice of Law: These Terms of Use are governed by California state laws. In the event of litigation, the prevailing party may recover reasonable attorney fees and costs.
Jurisdiction: All legal actions must be filed in state or federal courts located in California. The Client consents to jurisdiction in California and waives objections to it being an inconvenient forum.
General Provisions
Modifications: These Terms can only be modified through a written agreement signed by both parties.
Enforcement: Failure to enforce any term does not waive the right to enforce subsequent breaches.
Reservation of Rights: Real IQ LLC retains all rights not expressly granted.
Severability: If any term is found invalid, the remaining terms remain enforceable.
Electronic Communications: By agreeing to these Terms, the Client consents to receive electronic communications from Real IQ LLC, which satisfy any legal requirements for written communication.

By accessing Real IQ services or its website, you confirm that you agree to these Terms of Use. If you do not agree, you must refrain from accessing or using the services.
